Does My DUI Go Away After 10 Years?
One thing to note about DUI and "wet" reckless expungement is that there is a misconception out there that after a certain amount of time your criminal conviction gets removed from your criminal record automatically. This belief is FALSE, as your DUI conviction will never be automatically removed from your criminal record. To remove it you must pursue a DUI expungement pursuant California Penal Code 1203.4, which requires that you petition the court for relief. The 10 year rule only applies to your DMV record, wherein the DUI will fall off your DMV record 10 years after the conviction date. However, employers don't care about your DMV record, they care about your criminal record, and typically only conduct a criminal background check when considering you for an employment opportunity (unless the job involves driving).
Removing The DUI From The DMV Record?
This is probably the number one question we get. Unfortunately, expunging your DUI will not remove it from your DMV record, and consequently, will not effect your car insurance rate.
